Dispute Analysis
At our initial interview we aim to extract all relevant facts
from you as to the circumstances surrounding your dispute. Once
in possession of the facts we are is a position to analyse your
dispute in a legal context. It is then possible to draw conclusions
as to the strengths and weaknesses of your case and set ourselves
realistic objectives.
Case Management
Once a realistic approach to your dispute has been formed, it
will be skillfully managed. Any further material required to
support your case shall be researched and your case will be constantly
monitored. As the case continues to unravel, all legal avenues
will be pursued and every course of action available to promote
your case will be taken. We endeavour to use our knowledge of
the law and of the tactics often utilised in the litigation arena
to anticipate the thought processes occurring in the minds of
your opponents and to counter any strategies they may have. All
the while we will update you as to the progress of your case
via telephone, post or email, which ever is most convenient to
you.
Risk Management
As your opponents case unravels, the degree of risk involved
in the litigation will change. We will attempt to pre-empt any
surprises they may have which may increase the risk and do all
we can to minimise that risk. If at any point we feel that the
tables have turned permanently to our client's detriment, we
make them aware of the potential for failure and set our minds
on damage limitation.
Negotiation
The ability to negotiate effectively on behalf of your client
is crucial to the litigation process. It requires awareness of
a client's realistic position and anticipation of the opponent's
strengths and exploitation of their weaknesses. The litigation
department at BKS combine their litigation expertise with the
excellent people and communication skills required during the
negotiation process.
Advocacy
Our role is to present your case to a court in the best possible
light. We maintain excellent relationships with barristers in
every legal field, as well as non-legal professionals and experts
who can be called in to support your case and provide independent
advice.
